Federal Circuit Holds that ITC Termination of Investigation for Arbitration = Appealable Final Determination by Deborah S. Strauss

Deborah S. Strauss comments on the recent decision by the Court of Appeals for the Federal Circuit in InterDigital Communications, LLC v. International Trade Commission (USITC) in which the court reversed and remanded the USITC's termination finding that the Federal Circuit had jurisdiction to hear the appeal, and that the USITC erred in concluding that the termination of an investigation in favor of arbitration was "the equivalent of a final determination" and was therefore an action that could be appealed.
