ITC Gets Creative To Limit NPE Access Under Section 337

Tom M. Schaumberg and Evan H. Langdon recently posted this article for IP Law 360 entitled, ITC Gets Creative to Limit NPE Access Under Section 337.

The article discusses the International Trade Commission's recent notice of institution of investigation, for the first time, ordering an administrative law judge to "hold an early evidentiary hearing, find facts, and issue an early decision, as to whether the complainant has satisfied the economic prong of the domestic industry requirement."  This puts significant pressure on NPEs and reduces its leverage to extract settlement, at the same time reducing expense to the respondents.
